1. Agreement to Terms
By installing, accessing, or using Analyzify Purchase Surveys (the "App", "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App.
These Terms constitute a legally binding agreement between you ("Merchant", "you", or "your") and Analyzify ("we", "us", or "our").
2. Description of Service
Analyzify Purchase Surveys is a Shopify application that enables merchants to:
- Create and manage post-purchase customer surveys
- Display surveys on Thank You pages after purchase completion
- Collect customer feedback and responses
- View real-time analytics and metrics
- Export survey data as CSV files
- Collaborate with team members on survey management
3. Eligibility
To use this Service, you must:
- Have an active Shopify store
- Be at least 18 years old or the age of majority in your jurisdiction
- Have the legal authority to enter into this agreement on behalf of your business
- Comply with all applicable laws and regulations
- Not be located in a country subject to U.S. government embargo or designated as a "terrorist supporting" country
- Not be listed on any U.S. government list of prohibited or restricted parties
4. Account Registration and Security
4.1 Account Creation
- Your account is created automatically when you install the App from the Shopify App Store
- You must provide accurate and complete information
- You are responsible for maintaining the confidentiality of your account credentials
4.2 Account Security
You agree to:
- Notify us immediately of any unauthorized access to your account
- Be responsible for all activities that occur under your account
- Use strong passwords and enable two-factor authentication when available
- Not share your account credentials with unauthorized persons
4.3 Team Members
- You may add team members to access the App
- You are responsible for all actions taken by your team members
- You must promptly remove access for team members who no longer need it
5. Subscription and Payment
5.1 Pricing
- Current pricing is displayed in the Shopify App Store and within the App
- All fees are non-refundable except as required by law
5.2 Billing
- Subscription fees are billed through Shopify's billing system
- Billing occurs on a monthly or yearly basis
- You authorize Shopify to charge your payment method on file
- Failed payments may result in service suspension
5.3 Refunds
We do not provide refunds for partial months. Refunds are provided only in cases of:
- Service outages lasting more than 48 consecutive hours
- Billing errors
- Legal requirements
5.4 Cancellation
- You may cancel your subscription at any time through the Shopify App dashboard
- Cancellation is effective at the end of your current billing period
- No refunds are provided for the current billing period
- Upon cancellation, you will retain access until the end of the paid period
6. Acceptable Use
6.1 Permitted Use
You may use the Service only for lawful purposes and in accordance with these Terms.
6.2 Prohibited Activities
You may NOT:
- Use the Service to collect sensitive personal information without proper consent
- Send spam or unsolicited communications through the Service
- Violate any applicable laws, regulations, or third-party rights
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to the Service or related systems
- Use the Service to harass, abuse, or harm others
- Collect data about children under 13 (or 16 in the EEA) without parental consent
- Reverse engineer, decompile, or disassemble the Service
- Remove or modify any proprietary notices or labels
- Use the Service for competitive analysis or to build a competing product
- Resell or redistribute the Service without authorization
- Use automated means to access the Service without permission
6.3 Survey Content
You are responsible for ensuring that:
- Survey questions comply with all applicable laws
- Surveys do not contain illegal, offensive, or discriminatory content
- Surveys do not request sensitive personal information without proper safeguards
- Survey content does not infringe on third-party intellectual property rights
7. Data and Privacy
7.1 Data Ownership
- You retain ownership of all survey responses and data collected through the Service
- We do not claim ownership of your data
- You grant us a limited license to process your data solely to provide the Service
7.2 Data Collection
The Service automatically collects:
- Survey responses when customers submit surveys
- Order ID only (to link responses for analytics purposes)
- Survey view data (timestamps, device type, session identifiers)
The Service does NOT collect:
- Customer email addresses or names
- Order amounts or values
- Product details from orders
- Customer type (new/returning)
- Customer contact information

7.3 Data Security
- We implement industry-standard security measures to protect your data
- However, no system is 100% secure, and we cannot guarantee absolute security
- You are responsible for maintaining the security of your Shopify account
7.4 Data Deletion
- You can delete survey data at any time through the App dashboard
- Upon uninstallation, all data is retained for 48 hours, then permanently deleted
- You can request immediate deletion by contacting help@analyzify.com
7.5 Data Backup and Export
- We maintain regular backups of data for disaster recovery
- You can export your data as CSV files at any time
- We recommend regular data exports for your records
8. Intellectual Property
8.1 Our Intellectual Property
- The Service, including all software, design, text, graphics, and logos, is owned by Analyzify
- We retain all rights, title, and interest in the Service
- These Terms do not grant you any intellectual property rights except as explicitly stated
8.2 Your Intellectual Property
- You retain all rights to your survey content and data
- You grant us a license to use your content solely to provide the Service
- This license terminates when you delete the content or uninstall the App
8.3 Trademarks
- "Analyzify Purchase Surveys" and related marks are our trademarks
- You may not use our trademarks without prior written permission
- Shopify's trademarks are property of Shopify Inc.
8.4 Feedback
- If you provide feedback or suggestions about the Service, we may use them without obligation to you
- You waive any rights to feedback you provide
9. Service Availability and Support
9.1 Availability
- We strive to provide 99.9% uptime
- We do not guarantee uninterrupted access to the Service
- Planned maintenance will be announced in advance when possible
9.2 Support
- Support is provided via email at help@analyzify.com
- We aim to respond within 24-48 hours for general inquiries
- Support is provided in English
9.3 Service Modifications
- We may modify, suspend, or discontinue the Service at any time
- We will provide 30 days' notice for significant changes
- We are not liable for any modification, suspension, or discontinuation
10. Third-Party Services
10.1 Shopify Platform
- The Service operates on the Shopify platform
- Your use is also subject to Shopify's Terms of Service and Privacy Policy
- We are not responsible for Shopify's actions or failures
10.2 Third-Party Integrations
- The Service may integrate with third-party services
- We are not responsible for third-party services or their availability
- Your use of third-party services is subject to their terms
11. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of data
11.2 No Warranty
WE DO NOT WARRANT THAT:
- The Service will be uninterrupted, secure, or error-free
- Defects will be corrected
- The Service is free of viruses or harmful components
- Results obtained will be accurate or reliable
11.3 Your Responsibility
You are solely responsible for:
- Your use of the Service
- Compliance with applicable laws
- Accuracy of data you collect
12. Limitation of Liability
12.1 Damages Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Business interruption
- Damages arising from your use or inability to use the Service
12.2 Maximum Liability
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification
You agree to indemnify, defend, and hold harmless Analyzify, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any laws or third-party rights
- Content you submit through the Service
- Actions of your team members
14. Term and Termination
14.1 Term
These Terms begin when you install the App and continue until terminated.
14.2 Termination by You
You may terminate by:
- Uninstalling the App from your Shopify store
- Canceling your subscription
- Contacting us at help@analyzify.com
14.3 Termination by Us
We may terminate or suspend your access immediately if you:
- Violate these Terms
- Engage in fraudulent activity
- Fail to pay subscription fees
- Pose a security risk
14.4 Effect of Termination
Upon termination:
- Your access to the Service ends immediately
- Data is retained for 48 hours, then deleted
- You remain liable for any outstanding fees
- Sections that should survive termination will continue (e.g., liability limitations, indemnification)
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by the laws of Estonia, without regard to conflict of law principles.
15.2 Dispute Resolution
For any disputes:
- Informal Resolution: Contact us first at help@analyzify.com to resolve informally
- Mediation: If informal resolution fails, we agree to mediation before litigation
- Jurisdiction: Any legal action must be brought in the courts of Estonia
15.3 Class Action Waiver
You agree to resolve disputes individually, not as part of a class action or representative proceeding.
16. Changes to Terms
16.1 Modifications
We may modify these Terms at any time by:
- Posting updated Terms on this page
- Updating the "Last Updated" date
- Notifying you via email for material changes
- Displaying an in-app notification
16.2 Your Acceptance
Continued use after changes constitutes acceptance. If you don't agree to changes, you must stop using the Service and uninstall the App.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Analyzify.
17.2 Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
17.3 Waiver
Our failure to enforce any right or provision does not constitute a waiver.
17.4 Assignment
You may not assign these Terms without our consent. We may assign these Terms without restriction.
17.5 Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control.
17.6 No Agency
These Terms do not create a partnership, agency, or employment relationship.
17.7 Notices
Notices to you may be sent to your Shopify account email. Notices to us should be sent to help@analyzify.com.
17.8 Export Compliance
You agree to comply with all export and import laws and regulations.
18. Specific Provisions for Different Jurisdictions
18.1 European Union
If you are located in the EU, you have additional rights under EU law, including rights under the GDPR (see Privacy Policy).
18.2 California
California residents have rights under the California Consumer Privacy Act (see Privacy Policy).
18.3 Canada
Canadian users' personal information is protected under PIPEDA.
18.4 Australia
Australian consumers have rights under the Australian Consumer Law that cannot be excluded.
